  8. You are granted a licence to use Texplore according to the following rules:

  10. 1. Registration
  11.  
  12.    If you have the shareware version of Texplore and you are happy with it and
  13.    intend to use it, you must register it. The initial screen of the Query
  14.    program explains how. You pay a one-off fee to Agate Software Ltd and
  15.    receive in return (1) an up-to-date copy of the program on diskette, (2) a
  16.    printed user manual, (3) software to customise the initial screen and title
  17.    lines of the Query program, and (4) the right to advice and support by
  18.    telephone.

  20. 2. Single machine
  21.  
  22.    You can only use the Texplore INDEX and BLEND programs on one computer. The
  23.    rest of the Texplore software, including the QUERY program, can be
  24.    distributed freely, according to the rules below. If the computer is a
  25.    multi-user or a file server, then each user of the INDEX and BLEND programs
  26.    must register.

  28. 3. Copies for friends
  29.  
  30.    We are very happy for you to give copies of the shareware version of
  31.    Texplore to other people, so that they can "try before they buy". (The
  32.    shareware version has an initial screen explaining the shareware concept.)
  33.    However you must (1) make no charge (except for costs of providing the
  34.    copy), and (2) include all the Texplore files. You can even include a text
  35.    database, provided it is for demonstration purposes only.

  37. 4. Transfers

  39.    You can transfer your Texplore licence to another person, provided that you
  40.    hand over this licence agreement and delete all copies of Texplore that are
  41.    not transferred.

  43. 5. Copies
  44.  
  45.    You can copy the Texplore files in any machine-readable form, provided this
  46.    is done solely for back-up purposes, so that you have a secure copy or
  47.    copies of the files.

  49. 6. Distributing databases (for free)
  50.  
  51.    You can distribute Texplore along with any text database. You must first
  52.    register Texplore. You will then be able to customise the text on the
  53.    initial screen and title lines of the Query program, for example to
  54.    identify your company. You must not include the INDEX and BLEND programs in
  55.    the distribution, unless you also provide the shareware version only of the
  56.    QUERY program. If you make no charge either for Texplore or the database,
  57.    then you pay no fee to Agate Software Ltd.

  59. 7. Distributing databases (for a fee)
  60.  
  61.    If you distribute Texplore with a text database for a charge or fee,
  62.    paragraph 6 above applies, except that you must pay Agate Software Ltd a
  63.    fee of 50 UK pounds. If the distribution is on a regular basis, say once a
  64.    month or quarter, then the fee is 100 UK pounds per year, payments falling
  65.    due at the start of distribution and at 12 month intervals thereafter until
  66.    distribution ceases.

  68. 8. Limited warranty

  70.    If you find any physical defect in the Texplore diskette or documentation, 
  71.    Agate Software Ltd will replace it free of charge, provided you return the
  72.    item to be replaced, with proof of payment during the one year period after
  73.    receiving it.

  75.    Although we have tested Texplore and its checked its documentation very 
  76.    thoroughly to ensure that as far as possible it is if the highest quality 
  77.    possible and free from errors, Agate Software makes no warranty or 
  78.    representation express or implied with respect to this software or 
  79.    documentation, its quality, performance, merchantability or fitness for
  80.    a particular purpose.

  82.    Agate Software Limited, its subsidiary companies, dealers, distributors and
  83.    employees cannot be held responsible for direct, indirect, special, 
  84.    incidental or consequential damages arising out of the use of or inability 
  85.    to use the software or documentation, even if advised of the possibility of 
  86.    such damages.

  88.    This warranty in no way diminishes statutory rights.
